Welcome to Vieta. These Terms of Service ("Terms") govern your access to and use of the Vieta iPad app, the Vieta website (vieta.cc), and any other services we operate (together, the "Service"). By using the Service you agree to these Terms. If you don't agree, don't use the Service.
Accounts
You must be at least 13 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account. Notify us immediately if you suspect unauthorised use.
You must provide accurate information when you sign up and keep it current. We may suspend or terminate your account if you violate these Terms.
Acceptable use
You agree not to use the Service to: violate any law; infringe the intellectual property or privacy rights of others; transmit malware or attempt to gain unauthorised access to our systems; harass, abuse, or threaten other users; or scrape, mirror, or otherwise extract data from the Service in bulk without our written permission.
You agree not to misrepresent your activities — for example by uploading rides recorded by another rider or by fabricating data — particularly in relation to leaderboards, segments, or competitions.
Subscriptions and payment
Some features of the Service require a paid subscription. Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. Pricing and inclusions are shown at the point of sale.
Refunds are governed by our Refund Policy.
Your content
You retain ownership of the rides, comments, and other content you submit to the Service ("Your Content"). By submitting Your Content you grant us a worldwide, royalty- free licence to store, display, and process it as needed to provide the Service to you and (where you have made it public) to other users.
You are responsible for Your Content and represent that you have the rights to submit it.
Our content
The Service — including the Vieta name, logos, software, ride catalogue, and original ride video content — is owned by Vieta or our licensors and is protected by intellectual-property laws. We grant you a limited, non- exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial use, subject to these Terms.
Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
Vieta is a virtual cycling app. You are responsible for your own safety while riding. Consult a doctor before starting any exercise programme. Don't use the Service in a way that distracts you from riding safely.
Limitation of liability
To the fullest extent permitted by law, Vieta will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service.
Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.
Governing law
These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of- laws provisions. The exclusive venue for any dispute arising out of or related to these Terms is the courts located in Melbourne, Victoria.
Changes
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. If we make a material change we will notify you in the app or by email. Continued use of the Service after a change means you accept the updated Terms.
